**Short answer:** Yes, an AI receptionist can transfer a caller to a real person, and it should. The version that works is a **warm transfer**: the AI keeps the caller on hold, dials your person, privately tells them who's calling and why, then connects the call. If nobody picks up, the caller gets a specific callback time and a task lands in your CRM. No voicemail, no dead air. California just turned that standard into law for big companies: starting January 1, 2027, businesses with more than $500 million in revenue must let California customers ask for a human and make a good-faith effort to connect them within 15 minutes or book a callback within one business day. Your business is almost certainly too small to be covered. Build to it anyway.

At Wrk Less we build AI voice receptionists on Retell for service businesses, and the handoff is the part we test hardest. Callers forgive an AI that answers on the first ring. They don't forgive one that traps them.

## What California's new "right to a human" law actually says

Governor Newsom signed [AB 1609](https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202520260AB1609), the Right to Human Customer Service Act, on September 28, 2026. It's [Chapter 733](https://ct35.capitoltrack.com/25/bill/ViewDoc?doc=%2F%2Fasm%2Fab_1601-1650%2Fab_1609_91_C_bill.pdf) of the 2026 statutes and adds Sections 22625 to 22629 to the Business and Professions Code. As [Weiner Brodsky Kider summarized on October 16](https://www.thewbkfirm.com/industry/ca-to-regulate-large-businesses-use-of-customer-service-chatbots), it takes effect January 1, 2027.

Here's what the chaptered text requires, and how we build the same thing for a small HVAC shop or a two-agent real estate team:

| What AB 1609 requires (large businesses) | Exact rule in the text | How we build it for a small business anyway |
|---|---|---|
| Never claim the bot is human | §22626(a): may not "represent that a customer service chatbot is a human" | Hard rule in the prompt: any version of "Are you a real person?" gets "I'm an AI assistant" plus an offer to connect you |
| Disclose when callers could be fooled | §22626(b)–(c): clear and conspicuous disclosure, in the same medium | The greeting names the business and says it's an AI assistant, every call |
| A simple way to ask for a person | §22627(a): "commonly understood commands, prompts, menu selections, or verbal requests" | "Can I talk to someone?" in any phrasing triggers the transfer tool. No secret phrase, no menu maze |
| Connect fast or book a time | §22627(b): connection within 15 minutes, or "a specific appointment time within one business day" | Warm transfer first. If no answer, the agent offers a real time slot and creates a callback task |
| Cap hold times | §22627(c): no more than 15 minutes on hold at a time, one hour total | Short ring timeout on the transfer leg. Nobody sits on hold music while the AI waits |
| Penalties | §22628: up to $5,000 for a first violation, $10,000 for each one after, enforced by public prosecutors only | No private right of action, and it doesn't reach most small businesses. The penalty for a bad handoff is a lost job |

Two carve-outs matter. A request by email, web form or voicemail doesn't trigger the 15-minute clock (§22627(e)). And "large private business" means more than $500,000,000 in gross annual revenue nationally (§22625(g)). Hospitals, consumer reporting agencies, regulated utilities and "exclusive business lines" (internal and business-to-business lines) are exempt.

So why should a plumber in Orlando care? Because the biggest companies your customers deal with will start offering this on January 1, and caller expectations move with them. The rule also sits on top of disclosure laws that already reach small businesses. Maine and Utah are covered in our [AI receptionist disclosure rules](/blog/ai-receptionist-disclosure-laws) breakdown.

## Cold, warm or screened: the three ways an AI hands off a call

Retell's [Transfer Call tool](https://docs.retellai.com/build/single-multi-prompt/transfer-call) offers three modes, and most platforms offer some version of the first two.

| Transfer type | What the caller experiences | What your person hears | When we use it |
|---|---|---|---|
| **Cold transfer** | Rings straight through to your number. The AI drops off | Nothing. They pick up blind | Routing to a staffed front desk or main office line |
| **Warm transfer** | Short hold, then connected | A private "whisper" only they can hear: who's calling and why. Optionally a three-way intro | Our default for owner-operators and on-call techs |
| **Agentic warm transfer** | Short hold, then connected, or the AI comes back and books a callback | A second AI agent asks if they can take the call, then bridges or cancels | When the person who answers might be on a roof, driving or with another client |

The whisper is the part that changes the call. Your tech picks up and hears "Caller is Dana, water heater leaking in the garage, existing customer, wants someone today" before the line connects. They know what they're walking into. A cold transfer gives them "Hello?" and a frustrated customer repeating themselves.

The agentic version fixes the failure we design around most: a transfer that rings through to a person who can't talk right now. Retell's transfer agent can only do two things, bridge or cancel. If your tech says "not now," the caller goes back to the main agent, which books the callback instead of dumping them into voicemail.

Billing detail worth knowing: Retell bills the normal per-minute rate while the agent is holding and briefing. Once the caller is connected and the AI drops off, the agent fee stops and only telephony keeps running. A long transferred call doesn't burn AI minutes.

## How we build the handoff at Wrk Less

Every receptionist we ship gets the same handoff spine. Here's the checklist, in the order we build it:

- [ ] **Write the transfer triggers into the prompt.** A caller asking for a person, in any phrasing. An emergency keyword you choose: burst pipe, no heat, gas smell. An upset caller. A question the agent was told not to answer, like a firm price on a custom job.
- [ ] **Pick the destination by rule, not by guess.** Business hours go to the office line. After hours go to the on-call phone or to a booked callback. Use a dynamic variable when the right person changes by service or by day.
- [ ] **Write the whisper.** Name, reason, new or existing customer, how urgent. One sentence.
- [ ] **Set a short ring timeout.** Retell lets you set the ring duration per transfer. Ours is tight, because a caller listening to rings isn't being helped.
- [ ] **Decide what caller ID your person sees.** Showing the caller's real number needs caller ID override support. Retell's docs say Twilio numbers support it on warm and cold transfers, and Telnyx numbers only on cold. If override isn't supported, the transfer fails. We test this on every new number.
- [ ] **Build the fallback before you need it.** No answer means the agent offers a specific callback time, confirms the number back, and fires a task into your CRM. We wrote up that task pattern in [how AI creates tasks after seller calls](/blog/ai-create-tasks-after-seller-calls).
- [ ] **Log every transfer attempt.** The post-call webhook writes "transfer attempted / connected / fell back to callback" to the CRM with the transcript. That's the data you'd need to prove a good-faith effort. Here's [how our Retell webhook handoff works](/retell-ai-integrations-and-webhooks.php).

### Already on GoHighLevel or Jobber?

You may not need a custom build. HighLevel's Voice AI supports call transfers, and Jobber's Receptionist escalates on keywords you choose. We compared both in [Jobber Receptionist vs. GoHighLevel Voice AI](/blog/jobber-receptionist-vs-gohighlevel-voice-ai) and covered where native tools run out in our [GoHighLevel AI receptionist guide](/blog/gohighlevel-ai-receptionist-2026).

## The 5-call handoff test we run before go-live

| # | Call to place | Pass looks like |
|---|---|---|
| 1 | "Can I just talk to a real person?" | Says it's an AI assistant, offers to connect, transfers without arguing |
| 2 | Emergency keyword during business hours | Warm transfer with a whisper that names the problem |
| 3 | Ask for a person while the destination doesn't answer | Specific callback time offered, number read back, task created |
| 4 | Ask for a person after hours | No ringing a closed office. Booked callback or on-call routing, per your rules |
| 5 | Caller refuses to talk to an AI at all | Transfer or callback offered right away. The agent stops collecting details |

Call 5 is also a recording issue. In all-party-consent states like Florida, an objection to the AI means the AI conversation should end. More on that in our [AI call recording laws](/blog/ai-call-recording-laws) guide. And if the fallback is a text instead of a call, check the rules in [is missed-call text-back legal](/blog/missed-call-text-back-tcpa-2026) first.

The "I need to talk to a person" call is also test #5 in our [AI receptionist buying guide](/blog/ai-receptionist-small-business-buying-guide) scorecard. If a vendor's agent can't pass it, it isn't a receptionist.

## The bottom line

The law only covers giants, but the standard it sets is the right one for everybody: tell people it's AI, let them ask for a human in plain words, connect them fast or give them a real time, and never leave them on hold. An AI receptionist that follows them books more jobs than one that sounds slightly more human and traps people.

## Questions people ask

### Can an AI receptionist transfer a call to a real person?

Yes. Most AI receptionist platforms can hand a live call to a person. The best setup is a warm transfer: the AI holds the caller, dials your staff member, privately tells them who is calling and why, then connects the call. If nobody answers, the AI should offer a specific callback time and create a task in your CRM instead of sending the caller to voicemail.

### What is the difference between a warm transfer and a cold transfer?

In a cold transfer the AI sends the call straight to another number and drops off, so the person who answers knows nothing about the caller. In a warm transfer the AI stays on the line, briefs the person privately or introduces the caller, and only then connects them. Some platforms, including Retell, also offer an agentic warm transfer, where a second AI asks the person if they can take the call before connecting.

### Does California's Right to Human Customer Service Act apply to small businesses?

No. AB 1609, signed September 28, 2026 and effective January 1, 2027, covers businesses with more than $500 million in gross annual revenue nationally that serve California customers. It requires them to let customers ask for a human, make a good-faith effort to connect within 15 minutes or schedule a callback within one business day, limit hold times and never claim a chatbot is human. Small businesses are not covered, but disclosure laws in states like Maine and Utah can still apply.

### What should happen if nobody answers an AI receptionist's transfer?

The caller should never hit dead air or a generic voicemail. A well-built AI receptionist ends the transfer attempt after a short ring timeout, returns to the caller, offers a specific callback time, reads the phone number back to confirm it, and creates a callback task in your CRM with a summary of the call.

### How do I test whether my AI receptionist's human handoff works?

Place five test calls before going live: ask for a real person, use an emergency keyword during business hours, ask for a person when nobody can answer, ask for a person after hours, and refuse to talk to an AI at all. Each call should end in either a connected transfer or a booked callback with a task in your CRM.
